Please read these terms carefully before using our Service.
AGREEMENT TO TERMS
These Terms of Service ("Terms") constitute a legally binding agreement between you (either an individual or an entity, "you" or "your") and Where My Money Went ("Company," "we," "us," or "our") regarding your access to and use of our customer journey analytics platform and related services (collectively, the "Service").
BY ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICE.
Definitions
- •"Account" means the account you create to access and use the Service.
- •"Customer Data" means any data, information, or content that you or your end users provide to or generate through the Service.
- •"Documentation" means the user guides, documentation, and other materials we make available regarding the use of the Service.
- •"Subscription Plan" means the specific service tier you select (Starter, Growth, Professional, or Enterprise).
- •"Usage Limits" means the limitations on usage specified in your Subscription Plan, including monthly visitor limits, data retention periods, and feature access.
Eligibility
2.1 Age Requirement
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.
2.2 Authority
If you are using the Service on behalf of an organization, you represent and warrant that:
- You have the authority to bind that organization to these Terms
- You agree to these Terms on behalf of that organization
- References to "you" in these Terms include both you individually and that organization
2.3 Prohibited Users
You may not use the Service if:
- You have been previously suspended or banned from the Service
- You are located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country
- You are listed on any U.S. government list of prohibited or restricted parties
Account Registration and Security
3.1 Account Creation
To use the Service, you must:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Select a Subscription Plan
- Provide payment information for paid plans
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Use a strong, unique password
- Enable two-factor authentication when available
- Not share your account credentials with others
- Notify us immediately of any unauthorized access
Subscription Plans and Payment
We offer multiple Subscription Plans with different features. Current plans and pricing are available at wheremymoneywent.cloud/pricing.
4.2 Free Trial
New users may be eligible for a 14-day free trial. You can cancel anytime during the trial period without being charged.
4.3 Billing and Payment
- Billing Cycle: You will be billed monthly or annually based on your selection.
- Automatic Renewal: Your subscription automatically renews unless canceled.
- Price Changes: We may change pricing with 30 days' notice.
- Taxes: Prices do not include applicable taxes.
4.6 Late Payment
If payment fails, we will notify you. Your account may be suspended if payment is not received within 7 days.
Use of the Service
5.1 License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.
5.3 Acceptable Use
You agree NOT to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Transmit harmful code (viruses, malware)
- Attempt to gain unauthorized access
- Collect or harvest user data without authorization
- Reverse engineer, decompile, or disassemble the Service
Customer Data
6.1 Ownership
You retain all ownership rights to your Customer Data. We do not claim ownership of any Customer Data.
6.2 License to Use Customer Data
You grant us a limited license to store, process, and transmit Customer Data to provide the Service and to maintain or improve the Service.
6.5 Data Retention
We retain Customer Data according to your Subscription Plan. After the retention period, data may be deleted or archived.
Intellectual Property
The Service, including all software, technology, content, designs, and trademarks, is owned by or licensed to us. All rights not expressly granted are reserved.
You may not copy, modify, create derivative works of, or reverse engineer the Service.
Third-Party Integrations
The Service may integrate with third-party platforms. Your use of these integrations is subject to these Terms and the third party's terms.
We do not endorse or control third-party services and are not liable for issues arising from them.
Confidentiality
Each party agrees to keep the other party's Confidential Information confidential and use it only for the purposes of these Terms.
"Confidential Information" includes business plans, technical information, customer data, and pricing.
Warranties and Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR $100 USD.
Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the Service, your violation of these Terms, or your Customer Data.
Term and Termination
You may terminate at any time by canceling your subscription. We may suspend or terminate your access for violations of these Terms.
Upon termination, your right to use the Service ends immediately, and we may delete your Customer Data after 90 days.
Dispute Resolution
14.1 Informal Resolution
We agree to attempt to resolve disputes informally for 30 days before filing a claim.
14.2 Arbitration Agreement
Disputes will be resolved by binding arbitration rather than in court, with limited exceptions. You waive your right to a jury trial and class actions.
General Provisions
These Terms constitute the entire agreement between you and us.
